1. Terms of use

1.1 Object of agreement
Our terms of use describe how you can use the services of Pixunty and how we provide them for you.

In this agreement "Pixunity" means...

The following terms especially regulate the use of Pixunity, uploading, saving and editing pictures in photoblogs as well as making it available for other users on the internet.


1.2 Area of application

The services of Pixunity especially creating and saving photoblogs can only be used after a registration at Pixunity. To become a member of Pixunity you have to fill out the registration form completely and thruthfully and keep your personal data up-to-date. The account and a membership will be created by a special e-mail from Pixunity after the registration process. By clicking the link in this e-mail the account will be activated and the user accepts the terms of uses and the service provided by Pixunity. The user is supposed to keep his user data (username and password) secret. Furthermore does the user receive the Pixunity newsletter. The user can unsubscribe this newslette in his personal Pixunity-profile.


2. Service of Pixunity

2.1 Photoblog-service

Pixunity allows the user to upload personal pictures in photoblogs, save and edit them. The user has the possibility to give access to these picture files to other external users or to invite other users to co-edit his photoblogs. The user can decide wheter his photoblogs should be private and can only be accessed by users he has given access or if his photoblogs are public and anyone on Pixunity can access these. The owner and possible co-editors of a photoblog are responsible for the content of the photoblogs in equal shares.


2.2 Warranty

Pixunity guarantees that the plattform corresponds with the essential functional descriptions and that its server have a avaliability of 97% over the year.
Excluded of this warranty are all errors that cannot be influenced by Pixunity and result from external effects, errors in use or changes, additions or other manipulations not done by Pixunity
Furthermore Pixunity cannot guarantee for the presentation of pictures, photoblogs and photobooks. If the user experiences problems he/she has to report these problems tp Pixunity.


3. Rights of use

If the user creates public photoblogs at Pixunity he gives Pixunity the gratuitous right to make this file accessible for others on the internet. Private photoblogs are only accessible for those users authorized by the owner of these photoblogs.

For public photoblogs the user gives Pixunity and all other users of Pixunity the gratuitous and unlimited right to show reduced versions of these pictures and photoblogs on other websites and link to the public photoblog at Pixunity. Furthermore this includes the right to forward this content and other comparable rights without claim of compensation for the user or others. The right of withdrawal can be executed anytime by deleting the content.

Every user is responsible for getting the necessary rights for uploading content (photos, text etc.) and its use.
Responsible for the content of private and public photoblogs is the user that has uploaded this content. So a user has to make sure that he/she has the neccessary rights to use this content.

The user assures that he is the sole holder of all neccessary rights of the uploaded picture files and all other content whish is published on Pixunity. If a third party claims that their rights are violated then the user assumes responsibility that he will indemnify Pixunity from all claims of the third party and that the user will make up for all damages if the user is responsible for theses damages.

Pixunity reserves the right to block or delete users from Pixunity according to these terms of use and at its own discretion if the user acts against the intellectual property of a third party or to delete an account which acts against the intellectual property of a third party.


4. Content

Uploading content concerning political activities like conventions, demonstrations, political symbols etc. is not allowed. It is also not allowed to upload content which insults other users or people or harms them in any other way.
The user is not allowed to send or save data to/on a data storage medium of Pixunity that put the service of Pixunity at risk. Damages have to be compensated by the relevant user.

Pixunity is allowed to block or delete content if not appropiate or to terminate the agreement. Pixunity has no auditing duty.
